RETURN OF LEASED DEVICE POLITICS


Introduction

At SET, your health and well-being are at the heart of our commitment. 

This Rental Device Return Policy is intended to clearly set out the terms and conditions applicable to the return of rental devices and to ensure a simple and transparent experience. 

The Lessee acknowledges having had the opportunity to review this Policy prior to entering into the rental agreement. 


Return of the device

  • The Lessee must return the rented device to SET at the end of the rental period, unless they choose to purchase the device in accordance with the terms set out in the agreement; 
  • The device must be returned in good working condition, clean, and complete with all originally supplied accessories, subject to normal wear and tear resulting from proper use. 


Return process

  • The Lessee must use the return shipping label provided by SET, where applicable; 
  • The Lessee is responsible for securely packaging the device to prevent damage during transport; 
  • The Lessee remains responsible for the device until it has been received by SET; 
  • If the device is not returned within the specified timeframe or in accordance with the agreed terms, return costs may be charged to the Lessee. 


Device evaluation

  • Upon receipt of the returned device, SET will conduct an evaluation to verify its condition and proper functioning; 
  • If damage beyond normal wear and tear or missing components are identified, the Lessee may be held responsible for the cost of repair or replacement. 


Return default and applicable fees

The Renter must return the device at the end of the rental period or contact SET to confirm their intentions. 

If the device is not returned within the prescribed period and the Renter fails to contact SET, the Renter will be deemed to be in default of their obligations. 

In such circumstances, SET may claim, as applicable: 

  • outstanding rental fees; 
  • fees related to the continued use of the device; 
  • reasonable costs incurred in recovering the equipment; 
  • compensation for damages suffered, including, without limitation, the loss in value of the device or its residual value. 

 

The amount claimed will be determined based on various factors, including: 

  • the length of time the device was retained; 
  • the condition of the device at the time of its return (or failure to return); 
  • its value at the time the default occurred. 

 

The device may be returned at any time. However, such return does not automatically waive any fees, costs, or compensation that may be applicable as a result of the delay or failure to return the device. 


Communication

The Lessee must inform SET of their intention to return the device or to proceed with its purchase in accordance with the terms of the agreement.

General provisions

  • This Policy is governed by the laws of the Province of Québec and the applicable laws of Canada. 
  • Certain provisions may vary depending on the laws applicable in the Lessee’s province or territory of residence. 


Conclusion

By renting a device from SET, the Lessee acknowledges having read and accepted the terms of this Policy.

Language

This Policy is originally drafted in French. An English version is provided for convenience only. In case of discrepancy, the French version shall prevail.
